By accessing and using AestheticSelect (aestheticselect.com), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this site.

AestheticSelect is an online directory that provides information about aesthetic treatment providers. We aggregate publicly available information about providers, including names, addresses, specialties, and patient ratings. Our goal is to help consumers find and compare aesthetic providers in their area.

No provider-patient relationship

Your use of the Site does not create a provider-patient relationship between you and any provider listed on the Site, nor between you and AestheticSelect. We are a directory service and do not participate in the delivery of healthcare services.

To the fullest extent permitted by law, AestheticSelect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Site. Disclaimer of warranties

The Site is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, secure, or error-free. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify and hold harmless AestheticSelect and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Site or your violation of these Terms of Service.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

Binding arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms of Service or the use of the Site, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Durango, Colorado. The arbitration shall be administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

The arbitrator shall have the authority to award any relief that would be available in a court of law. The arbitration shall be conducted by a single arbitrator. The costs of arbitration, including administrative fees and arbitrator compensation, shall be shared equally by the parties, unless the arbitrator determines otherwise.

Class action waiver. You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the fullest extent permitted by law: (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any dispute to be arbitrated on a class-action basis; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Exceptions. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. For any disputes not subject to arbitration, the exclusive venue shall be the state and federal courts located in La Plata County, Colorado, and you consent to the personal jurisdiction of such courts.

Changes to these terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will update the effective date at the top of this page. Your continued use of the Site after any changes constitutes acceptance of the new Terms.
